TERMS AND CONDITIONS
General Terms
This list cancels all previous lists.
- Prices are exclusive of V.A.T.
- All plants are offered subject to availability on receipt of the order.
- All plants are believed to be true to name, but in the event of an error on our part, our liability shall not exceed the invoice price of the variety in question.
- We hereby retain title to any plants sold until payment is received in full.
- As we have no control over the plants supplied by us once they have left our hands, we give no warranty, express or implied, after acceptance of delivery or collection.
Deliveries and Collection
- Unless otherwise agreed in the relevant Order, where Al Sajaa Nursery agrees to deliver the plants to the Delivery Location, Transport costs will be borne by the Client.
- Delivery Charges are based on the vehicle size required and the location. Delivery charges may be waivered at the discretion of Al Sajaa Nursery dependent on customer loyalty and cost of order.
- Delivery of the plants shall be made to the Client’s address set out in the Order or such other location as the parties may agree (Delivery Location) and the Client shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
- All deliveries are accompanied by a delivery note. The Client needs to have a person available to check the delivery with the driver, sign and accept the delivery.
- Delivery is completed on the arrival of the plants at the Delivery Location and the Client is solely responsible for unloading the plants.
Cancellation and Returns
If it is agreed that the plants are to be returned:
- The client will be liable for the cost of remedying any damage to the plants returned where such damage has, in the opinion of the Al Sajaa Nursery, been caused by the plants being inadequately packaged by the client or through the client’s fault; and Al Sajaa Nursery reserves the right to make a handling and restocking charge of 25% on plants which are returned if they were ordered in error or are no longer required.
- If plants which are either cancelled or returned have been specially purchased (e.g. plants that are not normally stocked by Al Sajaa Nursery), Al Sajaa Nursery reserves the right to make a handling, maintenance and administration charge of 75% of the sales price of the item(s) ordered, or render a charge equal to the cost of the plant(s), whichever the greater.
Ownership and Risk
- Ownership of the plants shall not pass to the Client until Al Sajaa Nursery has been paid in full for the plants.
- The client shall inspect the plants immediately upon receipt and shall notify Al Sajaa Nursery within 8 hours if the plants are damaged or do not match their order. If the client fails to notify Al Sajaa Nursery within 12 hours of delivery, the client is deemed to have accepted the goods.
- Al Sajaa Nursery shall not accept any liability for damage or defects once the plants have been planted.
